By downloading or using Spotter, you agree to these terms. We’ve kept them short and readable — please take a moment with them.
These Terms of Use (“Terms”) govern your use of Spotter (“the App”), operated by Damien Lutrin (“we”, “us”, “our”).
1. What Spotter does
Spotter uses AI to identify landmarks, food, wildlife, plants, signs, and other points of interest from photos you capture, and saves each one as a Spot in a personal travel journal with a synopsis and chat.
2. AI accuracy
Spotter’s identifications and synopses are generated by AI and may be incomplete or wrong. Treat them as a helpful starting point, not authoritative fact — especially for anything involving safety, health, wildlife, plants, allergens, or legal matters. Always use your own judgment.
3. Subscriptions
- Free — 3 identifications per day and 5 chat messages per Spot. Without an account, you get 1 identification to try before signing in.
- Spotter Premium — unlimited identifications, 25 chat messages per Spot, your choice of AI model, custom synopsis modes, and cross-device sync.
Premium is $6.99 per month or $39.99 per year, billed through your Apple App Store account. Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the current period ends, and your account is charged for renewal within 24 hours before that point. You can manage or cancel anytime in your App Store account settings. Refunds are handled by Apple under its policies; no refunds are provided for partial periods.
4. Your responsibilities
- You must be at least 13 years old to use the App.
- Spotter is for personal, non-commercial use.
- You are responsible for keeping your account credentials confidential.
- You won’t use the App for any unlawful purpose, or upload photos that are illegal or infringe others’ rights.
- You won’t use the App to identify people without their consent.
- You won’t reverse-engineer, overload, modify, or otherwise interfere with the App.
5. Your content
The photos you capture and the Spots you save are yours. You grant us only the limited permission needed to process them and deliver the service, as described in our Privacy Policy. The App — including its design, features, and AI models — is owned by us and protected by intellectual property laws.
6. Disclaimer of warranties
The App is provided “as is”, without warranties of any kind, express or implied. We do not warrant that it will be error-free, uninterrupted, or fit for your specific requirements, and identifications may be inaccurate or incomplete.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim under these Terms will not exceed the amount you paid us in the 12 months before the claim.
8. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or at our discretion. You may stop using the App at any time. On termination, your right to use the App ends immediately.
9. Changes to these terms
We may modify these Terms as Spotter evolves. The “last updated” date above will change accordingly, and continued use of the App after an update means you accept the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles.
11. Additional terms for Apple users
Because Spotter is distributed through the Apple App Store, the following also apply:
- These Terms are between you and Damien Lutrin, not Apple. Apple is not responsible for the App or its content.
- Apple has no obligation to provide maintenance or support for the App.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
